Agreement Confirmation

 

I confirm that by booking a painting retreat with French Painting Holidays, I have read and agree to the Privacy Statement and Terms and Conditions before my arrival.

 

Your booking is with French Painting Holidays, a company registered in New Zealand, NZBN: 9429052584169 and currently being registered in France. This agreement pertains to the Retreat (“Activity”) held at part or all of French Painting Holidays (“Property” or “Facility”).

Role Definitions

Organisers: Employees of French Painting Holidays

Facilitators: Independent contractors, such as guest instructors

Guests/Attendees/Participants: Anyone enrolled in a Retreat by full payment.

 

Booking & Payments

Currency: All rates are in Euros and must be paid in Euros. Guests should confirm currency conversions with their financial institutions.

Deposit & Cancellation Policy: A 50% deposit is required to secure your booking (non-refundable due to associated costs and a limited number of painting guests, 6). Three months prior to the Retreat date, the balance is due. We recommend purchasing travel insurance for protection. No refunds are provided for early departure or unused activities.

Taxes

Our prices include VAT and Taxe de Séjour (Tourist Tax), which French Painting Holidays pays on your behalf.

 

Force Majeure 
In the event that the retreat cannot proceed due to circumstances beyond our control—including, but not limited to, acts of God, natural disasters, pandemics, government restrictions, or other force majeure events—French Painting Holidays reserves the right to cancel or postpone the retreat. In such cases, you will be offered the choice to transfer your booking to a future retreat date, receive a credit for a future booking, or obtain a full refund of payments received, in accordance with Article L211-14 of the French Tourism Code. Refunds will be made within 14 days of cancellation notification.

 

You are Unable to Attend

In accordance with Article L211-11 of the French Tourism Code, if you are unable to attend, you may transfer your booking to another person, provided you notify us in writing at least 7 days before the retreat start date. The replacement guest must agree to all terms and conditions.

Cancellation by Organisers

In the event of unforeseen circumstances, including serious illness of the Organisers or insufficient enrollment (fewer than 2 attendees), French Painting Holidays reserves the right to cancel the retreat. In such cases, all payments received for the retreat will be refunded in full within 14 days of notification, excluding incidental expenses such as airfare or travel arrangements made independently by guests.

French Painting Holidays will notify guests of any cancellation as soon as possible. No further compensation will be payable in the event of cancellation due to force majeure (including serious illness of the Organisers), insufficient enrollment, or other circumstances beyond our control, in accordance with French law.

 

Property Use & Guest Etiquette

We politely ask all guests to respect the Farm House and Barn House’s tranquillity and comfort. Smoking is not permitted, and guests are expected to return rooms in their original condition, assuming responsibility for any damages. The Farm House kitchen is not available for guest use.

 

Children Policy

Our retreats are exclusively for guests aged 18 or older. Minors under 18 are not permitted at these events unless specifically granted permission by French Painting Holidays. Should any guests under 18 be on the retreat grounds, they must be accompanied by a parent or legal guardian at all times, who assumes full responsibility for their care and supervision.

Assumption of Risk

Staying in a 200-year-old property involves certain risks, such as uneven surfaces and stairs up to most bedrooms. While comfort and safety are priorities, the Retreat's structure may cause challenges for guests with mobility concerns. By booking, guests assume these risks.  French safety standards are observed (e.g., fire safety, evacuation procedures).

 

Food Allergies & Dietary Restrictions

While we strive to offer a welcoming experience, we are unable to accommodate special dietary requests. We cannot guarantee an allergen-free kitchen. Guests with severe or life-threatening food allergies should carefully consider this risk before booking. French Painting Holidays Accommodation is situated in a natural environment with gardens and wildlife occasionally visit, which may present additional allergens for those with environmental sensitivities.

We reserve the right to cancel any reservation if we determine that safely accommodating specific dietary needs would be too challenging for our staff to fulfil with complete assurance.

 

Medical & Accessibility Considerations

Guests are responsible for managing health conditions and prescriptions. Due to the historic nature of the premises, accessibility may be limited; most bedrooms are upstairs. Participants should be able to walk unaided, carry their own luggage, and, for painting outings, carry a portable easel for at least 15 minutes.  

 

Room Assignments

Rooms vary in size; assignments are made in the order of registration. Basic toiletries, linens, and towels are provided. To maintain the Barn House’s ambience, rooms do not have televisions, though personal streaming devices are welcome.

 

Meals & Beverage Service

Our all-inclusive rate includes breakfast, lunch, and dinner, prepared with traditional French and seasonal ingredients.  We kindly advise that we are unable to cater for individual dietary requirements or allergies. We appreciate your understanding.

 

Alcohol Preferences

We aim to provide a selected wine experience. We cater for both preferences: alcoholic (wine, beer & cider only) and non-alcoholic beverages.

Intellectual Property & Media Consent

French Painting Holidays reserves the right to photograph and film during retreats for promotional use. Guests who prefer not to be included should notify us in writing before the retreat begins.

 

Liability Release

Guests acknowledge and assume the risks associated with their stay, including, but not limited to, accidents, acts of God, and pandemics. French Painting Holidays is not liable for personal injuries or losses.

 

Dispute Resolution

Any concerns during your stay should be reported immediately for rapid resolution. Disputes will be governed by French law (Department of Chalais), with mediation or arbitration in France if required.

 

Protect Your Trip

We strongly encourage guests to secure travel insurance to cover unexpected cancellations or interruptions. Trusted providers include World Nomads.

Payments are processed securely through trusted third-party payment providers. We do not store full credit card details on our servers.

If you do not wish to receive such communications, please contact us and we will respect your request and cease future communications. You can also unsubscribe via the relevant link in the communication you received.
What legal basis do we have for processing your personal information?
Generally, we collect personal information from you where processing is necessary for the performance of a contract to which you are party, where we have your consent, or where processing is necessary for the purposes of our legitimate interests.
